The supreme Court, while hearing a batch of supplications testing arrangements of the Surrogacy (Guideline) Act, 2021 and the Surrogacy (Guideline) Rules, 2022., clarified that it won’t hit down or obstruct anything without response to current realities of each case.
Whether the restriction of business surrogacy under Sections 4(ii)(b) and 4(ii)(c) of the Surrogacy (Guideline) Act, 2021 is constitutional
Whether the right of a couple to benefit surrogacy being limited to married couples between the age of 23 to 50 years in the case of female and between 26 to 55 years if there should arise an occurrence of male as given in Section 4(iii)(c)(I) read with Area 2(1)(h) of the Surrogacy (Guideline) Act, is constitutional.

Whether the right of a solitary lady to profit surrogacy being limited to just widows or divorced people between the ages of 35 to 45 years as given under Section 2(1)(s) of the Surrogacy (Guideline) Act 2021, is constitutional
Today, a bench of justices BV Nagarathna and Nongmeikapam Kotiswar Singh started hearing a request from one lady, aged 52 years of age, who had no kid from the second marriage. In this manner, the current request related to previously mentioned issue no. 2.
During the conference, justice Nagarathna communicated her interests that these cases should be seen relying upon realities of each case.
We would have perceived assuming they had said that ladies past 35 couldn’t undertake surrogacy…we would have struck it down. This is the problem…we need to see the item. Without specific facts of each case, we can’t say point clear that anyone past 50, for what reason mightn’t they at any point have (surrogacy)” she said
At the beginning, advocate Mohini Priya, showing up for the solicitor, presented that the act in prospective in application. Explaining, she said that regardless of whether couples have frozen their undeveloped organisms, they can’t involve them for IVF or surrogacy.
