NEW DELHI: The supreme Court on Monday wouldn’t give a stay on the Patna high court’s choice that rejected the Bihar state law reserving 65% of government jobs for scheduled castes (SC), scheduled tribes (ST), and in reverse classes
The bench, consisting of Chief Justice D Y Chandrachud and Justices JB Pardiwala and Manoj Mishra, agreed to consider the Bihar government’s 10 petitions challenging the Patna high court’s ruling. The apex court refrained from issuing notices on the pleas but granted leave for appeal, scheduling the hearing of the petitions for September.
The bench, comprising of chief justice D Y Chandrachud and justice J B pardiwala and Manoj Mishra, agreed to consider the Bihar government’s 10 petitions testing the Patna high court’s decision. The apex court refrained giving notification on the requests yet granted leave for appeal, planning the hearing of the petitions for September.
Senior advocate Shyam Divan, representing the state government, mentioned the bench to stay the high court’s structure, referring to a comparable case from Chhattisgarh where the supreme Court had remained the high court’s order. However, the Chief justice of India responded, “We will list the matter, however we won’t allow any stay (on the HC decision).”
Last month, Patna high court struck down a 65 percent reservation cap set by the state in government jobs and educational institutions. The state government had officially informed two bills in the state newspaper in November last year, meaning to raise the standard for denied ranks to 65%, bringing about Bihar having the most highest reservation rate among larger states, arriving at a total of 75%.
